Terms of service
By using Shotfax (the "Service") you agree to these terms. They are short on purpose.
0.Who you are contracting with
The Service is operated by Povilas Konopackas, registered as an individual activity under certificate (individualios veiklos pažyma) in Lithuania, EU. Contact: support@shotfax.com. Polar Software Inc. is the merchant of record for all purchases and issues the invoice that appears on your card statement.
1.Service description
Shotfax is a pay-per-use fax delivery service. You upload a document, provide a destination fax number, and pay a fee. We attempt to deliver the document via fax through our delivery partner Telnyx.
2.Pricing and payment
- $2.99 flat for documents up to 20 pages.
- Documents over 20 pages are not supported. The upload is rejected before payment.
- Payment is processed by Polar Software Inc. as merchant of record at the moment you send. No subscription, no recurring charges, no account. Polar handles VAT and sales tax collection where applicable. Your card statement will show POLAR * SHOTFAX.
3.Refund policy
- Failed delivery. If Telnyx reports the fax could not be delivered, we refund the full charge automatically within 7 business days. No ticket needed.
- Successful delivery. No refunds for faxes that Telnyx confirmed delivered to the receiving fax machine. That is the industry definition of "it went through." See section 3a for the EU right-of-withdrawal interaction.
- Disputes. Email support@shotfax.com with the job ID.
3a.EU right of withdrawal
Consumers resident in the European Union normally have 14 days to withdraw from a distance service contract under Directive 2011/83/EU (Consumer Rights Directive). Shotfax is a digital service that begins performance as soon as you pay and your fax is queued for transmission.
By ticking the acknowledgment box on the upload form and clicking "Send fax," you expressly request that Shotfax begin performance immediately and you acknowledge that, under Article 16(m) of Directive 2011/83/EU, your right of withdrawal is lost once the fax has been successfully delivered. If the fax fails, the automatic refund under section 3 applies regardless.
4.Acceptable use
You agree to:
- Only send faxes to numbers you are authorized to contact.
- Not use the Service for unsolicited fax marketing. Junk faxes are illegal under the TCPA in the US and under similar laws elsewhere.
- Not transmit content that is illegal, infringing, or harmful.
- Not send fraudulent, forged, or deceptive documents, or documents that impersonate another person, business, or public authority.
- Not use the Service for phishing, pretexting, or social-engineering of the fax recipient.
- Not send repeated unwanted faxes to the same recipient (harassment).
- Not transmit child sexual abuse material (CSAM). Violations are reported to the applicable authorities.
- Not use scraped, purchased, or otherwise non-consented lists of fax numbers.
- Comply with all applicable laws regarding the content you send.
5.HIPAA and PHI
Shotfax is not configured by default to receive Protected Health Information under HIPAA. If you need to send PHI, contact us first so we can arrange a Business Associate Agreement. Sending PHI through the standard service is at your own risk.
6.Limitations
- Maximum file size, 10 MB.
- Supported formats, PDF, JPEG, PNG.
- JPEG and PNG uploads are automatically converted to a single-page PDF before transmission, centered on US Letter paper with 0.5 inch margins.
- Fax is a black-and-white medium at 196 DPI. Color photos are converted to grayscale. Output quality reflects the quality of the source image. Blurry, low-contrast, dimly-lit, or heavily-compressed source images may not render legibly on the receiving fax. Shotfax is not responsible for poor source-image quality.
- International support depends on Telnyx's country coverage.
- Delivery is best-effort. We do not guarantee delivery within any specific timeframe.
7.Limitation of liability
To the maximum extent permitted by law, Shotfax's total liability for any claim arising from your use of the Service is limited to the amount you paid for the specific transaction in question. We are not liable for indirect, incidental, or consequential damages including missed deadlines, legal consequences of failed delivery, or business losses.
8.Service availability
We aim for high uptime but do not guarantee uninterrupted service. The Service depends on Cloudflare and Telnyx, which may experience downtime outside our control.
9.Changes
We may update these terms. Material changes will be posted on the site at least 30 days before taking effect.
10.Governing law
These terms are governed by Lithuanian law. EU consumers retain the mandatory protections of their country of habitual residence under Article 6 of Regulation (EC) 593/2008 (Rome I). Nothing in these terms reduces statutory consumer rights that cannot be waived by contract.
